1. The service and your agreement
These terms govern use of Survey Smarter, operated by DampSurvey Pro Ltd, company number 17029975, registered in England and Wales, at 3rd Floor, 86–90 Paul Street, London, EC2A 4NE. Contact jason@dampsurvey-pro.co.uk.
Survey Smarter provides software for professional survey records, photographs, observations, recommendations, reports, checklists and business administration. These terms apply when you register or use the service, together with any written order agreed with us. Our Privacy Policy explains data handling. You must have authority to act for any business whose account you create. The service is intended for adults using it for their work.
2. Accounts and access
Provide accurate registration details, keep sign-in access secure and use only accounts, properties and connected services you are authorised to access. You are responsible for actions by people you authorise to use your account. Tell us promptly about suspected misuse. Account permissions, trial or subscription status, connectivity and provider availability can affect which features are available.
3. Your professional responsibility
The software records and presents your work; it does not carry out an inspection, certify a property or supply an independent professional diagnosis. You remain responsible for the agreed inspection scope, competence, access and safety, evidence, accuracy, applicable duties and any advice or report issued to a client.
Check photographs, readings, property and client details, source references, recommendations, prices, signatures and final PDFs before saving, sending or relying on them. A reference building survey is another author's evidence; an extracted site checklist identifies matters to check, rather than confirming defects at your visit. Thermal photographs and moisture readings require competent interpretation and do not alone establish a cause.
4. AI assistance
AI features are optional and can produce errors, unsupported statements or omissions. Review and edit output against your evidence and the source document. Field answers are general assistance, not a substitute for professional judgment or specialist advice. Do not use AI output alone for safety-critical or consequential decisions about people. You are responsible for approving any proposed email, booking, invoice or recommendation before using it. Sending material to AI is subject to the disclosures in the Privacy Policy and the consent presented for that feature.
5. Email, calendars and other providers
Each user must authorise their own email or calendar connection. Provider verification, organisation policies, consent, quotas, changing APIs and expiring sessions may prevent or interrupt a connection. Features described in the app may require platform activation and are not a promise of Google or Microsoft approval.
Review recipients, wording, dates, times, duration and appointment clashes before approving an action. Calendar checking is limited to the calendars, date ranges and events available to the integration; it cannot guarantee that someone is free. Imported events and AI suggestions require review. Do not repeatedly retry an email whose send result is uncertain without checking the Sent folder. You must comply with the relevant provider's terms and avoid spam, impersonation or unauthorised access. Disconnecting does not retract sent mail or remove saved calendar events.
6. Saving, offline work and backups
Some work is saved on your device before it is synchronised. Prepare and test offline use online before a visit, check save and sync status and retain your own backups. Browser storage can be cleared, devices can be lost and connections can fail. A successful device save is not confirmation of a cloud backup. Keep important reports and evidence in storage appropriate to your professional obligations. Export or back up work before changing devices, clearing browser data, closing an account or changing services.
7. Your content and privacy responsibilities
You retain rights in the content you upload. You grant us permission to host, process, transmit and reproduce it only as needed to provide and secure the features you use, subject to our Privacy Policy and applicable law. We do not acquire ownership of your reports or photographs. You must have the right and lawful basis to upload material and to share it with the providers used by the requested feature, including AI where selected.
Where you control client or occupant information, give appropriate privacy information, limit unnecessary personal data and handle requests from those individuals. We process your submitted client content to provide the service on your instructions. Contact us about any additional data-processing agreement required for your organisation. Do not upload unlawful material, infringe copyright, expose credentials or submit content intended to compromise the service or other users.
8. Trials, charges and cancellation
The trial duration and any paid price, billing period and tax treatment are those shown when you sign up or check out. A no-card trial does not itself authorise a payment. A paid subscription starts only after you explicitly complete the relevant checkout. Where offered on a recurring basis, it renews on the schedule shown until cancelled.
Use the subscription management screen or contact us to cancel. Cancellation prevents future renewals once effective; access normally continues to the end of a period already paid for unless stated otherwise or a refund is agreed. Refund requests are considered under the agreed order and applicable law. Nothing here limits mandatory refund, cancellation or consumer rights that apply to you. Your professional surveying fees and invoices to your clients are your own agreements, not charges made by Survey Smarter.
9. Availability, changes and suspension
We aim to provide a useful, reliable service but do not promise uninterrupted operation or a particular third-party integration. We may maintain or change the service, address security issues or suspend access reasonably for unlawful use, serious breach, fraud, non-payment or protection of users. Where practicable we will explain material restrictions and give reasonable notice of changes affecting paid use. We will not use suspension as a reason to withhold rights required by law. Contact us about access to your records, exports or account closure.
10. Software ownership and acceptable use
We and our licensors retain rights in the software, brand and website. Your account permits use of the service for its intended business purpose while you have the relevant access. Do not bypass access controls or usage limits, attempt to obtain other users' data, disrupt the service, resell access without agreement or misrepresent generated material as an independently verified finding.
11. Responsibility and liability
We are responsible for providing the service with reasonable care and skill. You are responsible for your professional services, the content you supply, your decisions and the material you approve and send. We are not responsible for faults in third-party services outside our reasonable control, but remain responsible for our own obligations.
Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability or statutory right that cannot lawfully be excluded or limited. Any claim will be assessed under applicable law and the circumstances; these terms do not promise that software output or AI advice is error-free.
12. Closing accounts and resolving problems
You can request account closure or permanent cloud-data deletion by emailing us from the registered address. Export your work first and remove device copies or downloads separately as appropriate. Cancellation, erasure and removal of external provider data are distinct actions, as explained in the Privacy Policy. Some billing, security or dispute records may need to be retained.
Contact us first about service problems or a complaint so we can investigate. These terms are governed by the law of England and Wales, with courts there having jurisdiction, except that mandatory consumer protections and rights to bring proceedings elsewhere remain unaffected. We may update these terms to reflect service or legal changes, with appropriate notice of material changes.
